Residents of Dubai have been cautioned not to forgery dubai tenancy contract in order to get visas for family members.
Forgery of a document, according to UAE law is not allowed, Dubai residents are being advised against creating forged certified tenancy contracts in order to get visas for family members.
Dubai Courts recently investigated a number of cases in which people used forgery Dubai tenancy contract, water and electricity bills, and other documents to present to the General Directorate of Residency and Foreigners Affairs (GDRFA) in Dubai in order to renew their residency or obtain visas for family members. To acquire visas for family members, all renters in the UAE must have an authenticated lease agreement.
In a recent case heard by the Dubai Court of First Instance, a 35-year-old Syrian man was convicted with falsifying a lease contract from Sharjah, as well as the water and electricity invoices, in order to obtain a visa for his son.
According to records, the defendant provided the documents while seeking for a residence visa for his son at GDRFA in Dubai. “I examined the lease contract number on the Sharjah Municipality website and noticed that it was not certified. The stamp was untrustworthy. “The water and power bills were the same,” he explained.
When the employee inquired about the defendant’s residence, he appeared perplexed. “He eventually acknowledged that the documents were forged.”
According to the Dubai Public Prosecution, another individual, who is still at large, furnished the defendant with falsified documents.
In a second instance, a 36-year-old Sudanese lady is awaiting a court decision after her lease contract was discovered to be falsified and used to get a residency card for her mother.
In a third instance, the Dubai Court of First Instance punished a man to three months in prison for faking a tenancy agreement and using that to apply for his wife’s resident visa.
What the law says
As per Wageh Amin Abdelaziz, senior legal counsel at World Centre Advocates and Legal Consultants, candidates whose tenancy documents are discovered to be falsified face up to ten years in prison under Article 217 of the UAE Penal Code.

“Many individuals believe it is a minor infraction that will simply result in the application being denied. They have no idea that is a severe crime,” Abdelaziz told Dubai Euro Real Estate. “Regardless of the reasons, forgery of an official document is a crime. The UAE has distinct laws dealing with crime.”
According to Article 216 of the same legislation, fabrication of a document involves altering the facts and is likely to cause harm with the aim of using it as a legitimate document.
“Any alteration of a document, whether by removing or modifying the text, numbers, markings, or pictures included in such a document, is a forgery. “Creating a counterfeit signature or changing a real signature is likewise a kind of forgery,” Abdelaziz continued.
However, the legislation states that anybody who forges a duplicate of an official document and uses it can face up to five years in prison. Anyone who assists in the falsification of an official document will also face legal consequences.
“People really shouldn’t underestimate the serious implications of faking tenancy contracts or invoices since the individual would face police action even if the judge issues a moderate sentence,” Abdelaziz added.
He stated that a woman approached him for assistance after being tricked into purchasing a tenancy contract offered online. She was charged with forgery and using forged papers after discovering the document was a fabrication. “We urge everyone to respect the law and avoid taking shortcuts since the consequences are not worth the risk. People might risk prison and deportation,” Abdelaziz warned.
If a resident seeks to renew the visas of family members at GDRFA-Dubai, a tenancy contract is required.
The Real Estate Regulatory Agency (Rera) in Dubai stated in 2010 that all rental contracts will be required to be recorded on the Ejari online platform.
The Ejari lease registration is linked to the immigration server, enabling authorities to confirm the true occupier of the property covered by the tenancy agreement.

Unless otherwise specified, forging a formal document instrument is punishable by imprisonment for a term not exceeding ten years, while forging an informal document is punishable by imprisonment.
